COPYRIGHT

Auteursrecht

GENERAL

Copyright is a legal right created by the law of a state that grants the creator of an original work exclusive rights to its use and distribution. Not every state uses the same copyright term. In Europe, the copyright term is the life of the author plus 70 years.

WORKS OF ART

Works of art that may be subject to copyright include:

OBTAINING COPYRIGHT

A copyright is automatically obtained when creating an work meeting minimal standards of originality. No registration is required. Uniqueness of the work is not a requirement. In rare situations, two authors may own copyrights on two substantially identical works, if it is determined that the duplication was coincidental, and neither was copied from the other.

I-DEPOT

As no registration takes place, it is easier for someone else to claim ownership of your work. It can be difficult to disprove such a claim. We therefore recommend to submit your work using the I-DEPOT facility of the BOIP. The I-DEPOT allows you to prove that your work already existed on a certain date. However, the I-DEPOT does not offer (intellectual) property rights and does not offer legal protection.
